Dispute Resolution and Litigation

Even at the stage of negotiating a deal, businesses are advised to always take the risk of a dispute into consideration. Experienced lawyers could play an important role in either avoiding an actual dispute or resolving it in the most amicable way.
We assist our clients before an actual dispute arises, with the aim of avoiding disputes or at least of placing our clients in the best possible position in case they arise in any event. We draft pre-litigation settlements, where the combination of our skills as drafters and as litigators proves useful.
While we consider arbitration as an import aspect of dispute resolution, we represent clients before tribunals and courts of all hierarchies within the Maldivian legal system. We have experience in key areas such as cross-border commercial disputes, tax disputes, civil disputes, construction disputes, banking and insolvency disputes.
Arbitration requires keen appreciation of rules of the International Chamber of Commerce (ICC), Singapore International Arbitration Centre (SIAC), the Asian International Arbitration Centre (AIAC), Hong Kong International Arbitration Centre (HKIAC), and UNCITRAL. Furthermore, litigation in the Maldives requires expertise in domestic court procedures, fundamental rights and good faith balanced with the need to aggressively pursue the client’s interest where required.
Our lawyers meet all these requirements and are able to provide balanced and practical advice to the client as to their legal rights and remedies.
